Outland Sponsorship

Spouses and common-law partners of Canadian citizens and permanent residents can be sponsored for permanent residence in Canada through an arrangement known as “outland sponsorship,” which is available to those who live anywhere in the world.

 

Overview

Sponsorship by a Canadian spouse or partner entitles an eligible foreign national living abroad to apply for permanent resident (PR) status in Canada. To qualify for spousal sponsorship in Canada, a couple must currently be living together in Canada, which is not the case with the Outland sponsorship process.

If you can’t apply for spousal sponsorship in Canada, applying for sponsorship from outside the country may be your best bet. That is to say, if your family member is not already a Canadian citizen or permanent resident at the time of application, then Outland sponsorship is probably your only option.

Canadian applicants also have the option of using the Outland sponsorship system. It’s a good choice for people whose jobs or personal lives necessitate frequent trips in and out of Canada while their applications are being processed.

Both the sponsoring Canadian citizen or permanent resident and the sponsored foreign national must be approved by Immigration, Refugees, and Citizenship Canada for the sponsored foreign national to be issued a Canadian permanent resident visa through Outland sponsorship (IRCC).

 

Who qualifies for sponsorship from Outland?

Both the sponsor and the sponsored individual must meet several criteria in order to qualify as a sponsor under the Outland application category.

  • both the sponsor and the sponsored individual must be at least 18 years old; the sponsor must be a Canadian citizen or permanent resident;

sponsor and the sponsored individual must share one of the following relationships:

    • spouse: your marriage is valid under both Canadian and the law of the state where it was registered.
    • common-law marriage: you and your partner have lived together for at least 12 months in a legally recognized marriage-like relationship.
    • conjugal partnership *: you’ve been in a committed relationship for at least a year, but you can’t live together because of major legal constraints or other factors beyond your control, like an immigration barrier or marital status;

 

  • In the five years prior to the application’s submission, the sponsor cannot have sponsored a spouse to enter Canada.
  • Neither partner can be a felon, a bankrupt, or a prisoner;

 

For those interested in Outland sponsorship, how does it function?

To sponsor a family member or friend for immigration to Canada through the Family Class category, you must follow the steps outlined in the program’s Outland Sponsorship Application Guide.

Eligibility must be confirmed, supporting documents must be gathered, forms must be filled out, and the whole package must be delivered to the correct visa office. The foreign spouse or partner must apply for permanent residence in Canada, and the Canadian citizen or permanent resident must apply to become a sponsor.

How do I apply for a sponsorship in Outland?

Sponsorship applications for a foreign spouse or partner involve multiple steps:

  • First, download the application package from the government website; this package will provide you with a manual, instructions, and forms that will assist you in completing the application process in a timely and accurate manner.
  • The second step is to make a payment online for any application fees.
  • Third, fill out and sign any paperwork that must be done. Your spouse’s or partner’s country of residence may necessitate the completion of additional paperwork; research this thoroughly.
  • To complete the process, step four entails sending your documentation to the appropriate Canadian visa office and mailing address.

 

When applying to Outland, how long do you need to allow for processing?

When applying for a spouse sponsorship through IRCC, expect to wait around 12 months for a decision. A review of the sponsorship application and the eligibility requirements of the sponsor and the person being sponsored will add an additional few day to the total processing time.

When IRCC receives your application, they will send you a confirmation that they have received it. The following step is an approximately 4-month-long IRCC eligibility assessment of the sponsor. The final step is for the sponsored individual’s application for permanent residence to be evaluated, which can take up to six months.
