Is a Work Permit Required to Work in Canada?

 

There are more than a hundred different types of work permits available to foreign workers and their Canadian employers in Canada.

Canada’s immigration policies include the Temporary Foreign Worker Program (TFWP) and the International Mobility Program (IMP).

The TFWP differs from IP  because it requires an assessment of the local job market called a Labour Market Impact Assessment (LMIA).

Work Permit Categories in Canada

Canada offers two distinct work permit options:

  • To participate in the Temporary Foreign Worker Program, an LMIA (Labor Market Impact Assessment) must be completed.
  • With the International Mobility Program, a foreign national can get a work visa without first obtaining an LMIA.

The LMIA is designed to help companies show the Canadian government that they can hire foreign workers without depleting domestic labour. Employment and Social Development Canada (ESDC), a branch of the Canadian federal government, is concerned that bringing in foreign workers could lead to a loss of domestic jobs and a decrease in pay for Canadian workers. For workers who require an LMIA, the Temporary Foreign Worker Program is the appropriate venue (TFWP).

Despite the LMIA process being the norm, there are a variety of work permits that do not require an LMIA due to free trade agreements like the CUSMA (Canada-United States-Mexico Agreement), which replaced the NAFTA. Thanks to these pacts, businesses can hire foreign nationals without first securing an LMIA, allowing those individuals to apply for a work visa. Foreign workers who do not yet have a job offer have a few other options besides employer-sponsored work permits, such as working holidays, post-graduate work permits, and open spousal work permits. The International Mobility Program is for workers who do not require LMIAs (IMP).

LMIA Required

In order to apply for one of these work permits, an employer must first obtain a Labor Market Impact Assessment.

LMIA Exempt

In some cases, foreign workers can enter Canada without a Labor Market Impact Assessment.

CUSMA

These are issued for employment in the United States and Canada under the North American Free Trade Agreement (NAFTA), which replaced the LMIA.

Intra-Company Transfers

With one of these visas, a company can relocate certain workers to Canada from overseas without first obtaining an LMIA.

Business Visitors

As long as they don’t enter the Canadian labour market, business visitors can often work in Canada without a work permit.

Post-Graduation Work Permits

In Canada, international students who have graduated from a DLI are eligible to work for up to three years.
