If your status has expired within the last 3 months, you may be eligible to petition for a restoration of status. After entering Canada, you automatically qualify for TRV status. Depending on the reason for your visit, you may be able to extend your stay in Canada for up to an additional six months. For students it is equivalent to the length of the student’s academic program. An LMIA excluded work visa will be valid for the length of the job offer.
A foreign national’s inadmissibility to Canada may be based on their prior failure to comply with terms imposed upon admission (transaction costs are non-refundable), thus it’s important for them to leave the country before trying to reenter.
If a TR in Canada who previously possessed a study permit loses their status, they can request to have it reinstated and receive a new study permit. They can apply for and obtain a work permit for a fee if they match the criteria.
A former work permit holder who has lost their temporary residence status in Canada has 3 months to request for reinstatement of their status & employment permission. If they meet the criteria, they can apply for a study permit.
Once a visitor’s status has been reinstated, they can once again travel freely without worrying about their immigration status. Anyone who has been a TRV and is now eligible to apply for a work or study permit in Canada may do so when their status is reinstated.

Anyone seeking for restoration from outside the country must pay all applicable fees. The rate for restoration is CAD $200, however if the foreign national also needs a work or study permit, they must pay the cost recovery costs for each permit in addition to the fee for restoration. For instance, an applicant for a study permit restoration would have to pay both the restoration fee and the original study permit fee.
There is a 3 months window during which you can apply to have your status reinstated. Should your application for reinstatement of status be denied, you will have 3 additional months to re-apply. Restoration of your TRV can only be done inside Canada. If you leave Canada before your temporary status expires, you will need to apply for a new one in order to re-enter the country.
